TERMS AND CONDITIONS OF PARTICIPATION IN THE CONTEST:

The award includes the following concepts and conditions:

Flight for two people to any LATAM destination in South America operated by LATAM Airlines

1) Organizer:

This promotion called “Your dream destination is in South America” (Hereinafter, the “Promotion”, is organized by LATAM Airlines Group (hereinafter, the “Organizer”), NIF: W5121001A, with its address at Calle Poeta Joan Maragall 1, Piso 1 28020, Madrid, Spain, and will be governed by the applicable regulations on the matter and, particularly, by these terms and conditions (hereinafter, the “Terms and Conditions”).

2) Participants - Territory:

Any natural person over eighteen (18) years of age, domiciled in Spain, the United Kingdom or in Germany, who at the time of participating meets all the requirements demanded by these Terms and Conditions (hereinafter, “Qualifying Person/s”), may participate in this Promotion without obligation to purchase and completely free of charge. No employees or managerial staff of the Organizer, nor any of its companies that may be related, linked, controlling, controlled or subject to common control with the Organizer, companies contracted by the Organizer to provide collaboration or services related to the Promotion, companies related, linked, controlled or subject to common control with them, or relatives of the aforementioned persons up to the second degree of consanguinity, may participate in this Promotion. Neither may any worker or person related to the Ministry of Europe and Foreign Business participate.

3) Validity Period of the Promotion:

This “Promotion” will be valid from November 19, 2021 to December 5, 2021 (hereinafter, the “Validity Period”).

4) Mode of participation:

4.1. During the Validity Period, Qualifying Persons who wish to participate in the Promotion must, completely free of charge:

a) Enter the Internet Portals www.latam.com; (hereinafter the “Portal”)

b) Register by completing the exclusive registration form for this Promotion, which will be provided on the Portal (hereinafter the “Registration Form”), and must enter the following information in the corresponding fields: Email address, Name and Surname, and the correct answer requested in the contest. 1. For participation of the qualifying persons to be accepted for the Promotion, it is essential that the information is truthful and that it is entered in its entirety and correctly.

c) Register by means of any direct promotion activity that may carried out by the Organizer.

4.2. The qualifying persons thus registered (hereinafter, the “Participant/s”) will have the right to participate in the draw stipulated in these Terms and Conditions (hereinafter, the “Draw”).

4.3. During the period, only one (1) registration per qualifying person will be accepted.

4.4 The right to participate in the promotion is free, so it does not imply the payment of any surcharge to participate.

5) Prize:

The Prize consists of two airline tickets for the winning Participant (hereinafter, the “Winner”) and a companion, and these tickets are for roundtrip flights to any LATAM destination in South America operated by LATAM Airlines at the time of competing for the prize.

The tickets are in economy class and the validity period of the prizes awarded is 9 months from the date of handing over the prize, ending on the date by which the trip must be completed.

The reservation must be made at least 75 days in advance of the flight departure and is subject to availability.

The right to the Prize cannot be assigned to any other person. If the winner renounces the Prize, or if for any reason, they do not exercise their right to the Prize, this will not give them the right to exchange or obtain a refund for it, nor compensation of any kind.

The award does not include any hotels, transfers, meals or other expenses.

All procedures, taxes and fees related to the prize of this draw or associated additional expenses shall be borne by the winner, except for the expenses expressly cited in these Terms and Conditions that will be borne by the Organizers. Likewise, all expenses related to improvements and extras that do not correspond to the prize, as detailed in these terms and conditions, will be borne by the prize winner.

The organizers will not be responsible for any force majeure factors that may prevent the winner from going on their trip. By the same token, in the event that due to factors beyond the control of the organizers, some of the routes offered in this promotion become unavailable, the Organizers will not provide any tickets other than those already handed over.

6) Draw:

6.1. The Draw will be held within five (5) business days following the end of the participation period.

6.2. The Draw will be conducted by random choice or by random combination among all Participants in the Promotion.

6.3. The draw will be carried out through the platform http://www.random.org/integers/ for the application of generating random numbers from among all those registered in the promotion within the established period.

7) Awarding of the prize:

7.1. The Winner will be notified by email from December 6 by the organizer, to the email address provided by the participant on the Registration Form. The potential winner thus notified will have five (5) business days from the day the notification was sent, to accept or reject the Prize. Failure to expressly accept the Prize within the aforementioned period will be considered a rejection of the Prize, without admitting proof to the contrary.

7.2. The Prize will be considered to have been expressly accepted only if, within the previously indicated period, the Potential Winner responds via email to the notification email accepting the prize. Subsequently, they must provide their personal identification data (DNI, NIE or Passport) for themselves and their companion in order for the award of the prize to go ahead.

7.3. In the event that the Potential Winner (i) cannot be contacted due to errors or missing information, (ii) does not accept the Prize in accordance with the provisions of these Terms, (iii) renounces the Prize, or (iv) is disqualified for not meeting the requirements of these Terms and Conditions to qualify for the Prize, the Organizer will repeat the procedure described in items 7.1. and 7.2. above with respect to the first Alternative Participant – to whom the provisions therein will apply – and so on with respect to the other Alternative Participants, up to a maximum of two alternate participants so that one of them is determined as the Winner of the Promotion, as provided for in these Terms and Conditions to meet the applicable conditions. In the event of not accepting the prize, any of the three contestant winners (the holder and, failing that, the two alternates) will conclude the contest.

7.4. The Organizer will then proceed to deliver the tickets – which may be electronic tickets.

8) Responsibilities:

8.1. By the mere fact of participating in the Promotion, Participants understand and accept that interruptions, outages and/or any other deficiencies that could hinder Internet access and/or browsing will be at their own expense, including – but not limited to – deficiencies in the servers to access the portal or in the sending or receiving of emails, the loss of information, interruptions or malfunctions of the network or the servers, failures in the transmission of the telephone lines or technical failures in general that may affect participation in the promotion and/or receipt of emails addressed to the potential winner or which communicate the acceptance of the Prize.

8.2. In the event of cancellation of the flight indicated on the tickets delivered to the winner and/or his/her companion, or in the event of other force majeure situations, the Organizer will make best efforts to board them on the next flight, or combination of flights that take them to the destination indicated on the ticket. In no case will there be any obligation to board the winner or his companion on another airline.

8.3. In the event that for any other reason beyond the control of the Organizer, the winner and his/her companion cannot use all or part of the Prize, the Organizer will not be obliged to make any changes to the Prize or to issue tickets for other dates or to provide any compensation to the winner or their companion.

9) General Conditions:

•       No refund of the value, total or partial, of the unused prize may be requested.

•       LATAM may modify or change the legal terms and conditions of the draw, with just cause and prior notification to the clients.

•       LATAM will be exempt from any liability derived from any circumstance attributable to third parties that may affect the holding of the draw and/or the handover of the prize.

•       LATAM will not be responsible for any damage caused directly or indirectly by any action, omission or negligence attributable to the participants and/or winners.

•       LATAM will comply with any tax obligation it may incur, in accordance with the legislation in force at the time the prize is awarded.

10) Personal Details:

The personal data of the clients/participants will only be used for the purposes described above and will be processed in compliance with all current Regulations and in accordance with the Data Protection Laws.

The data of the participants may be communicated with the following third parties:

• Collaborating suppliers of LATAM, in order to comply with the correct carrying-out of the draw (such as, for example, transport and courier companies to deliver the prize).

•  Public authorities, in order to comply with LATAM’s legally enforceable obligations or prior legal, judicial or administrative requirements (such as, for example, the State security forces and bodies, the Courts and Tribunals, Autonomous Consumer Agencies or the Spanish Data Protection Agency).

• Rights

Right of access, rectification, deletion, opposition, limitation to processing and portability.

Participants may exercise the rights described outlined at any time by submitting a letter to the address indicated above, or to the email address pasajeros.europa@latam.com, specifying, in any case, what right they wish to exercise and accompanying such request with a photocopy of their DNI or equivalent identification document.

They may file a claim with the Spanish Data Protection Agency located at Callle Jorge Juan, 6 28001-Madrid.

• Personal data preservation period

Duration of the draw and, subsequently, during the period legally established for the statute of limitations applicable to any legal actions that may arise, as well as during the period of time legally established by tax or other legislation.

• Transfer to third countries

Not allowed

11) Territorial scope of participation and scope of the promotion:

This promotion is held in Spain, for people domiciled in Spain, the United Kingdom or in Germany who at the time and during their participation meet all the requirements demanded by these Terms and Conditions, and its organization will be within the national reach of the Organizer’s domicile and is governed by Spanish legislation.

12) Consultation of Terms and Conditions:

These Terms and Conditions may be consulted, during the Validity Period, through the Portal.

13) Acceptance of the Terms and Conditions:

Participation in the Promotion implies unconditional acceptance of these Terms and Conditions.
